Terms of Service — Encarnacion

These Terms of Service ("Terms") govern your access to and use of the Encarnacion website, store, and any purchase you make from us (the "Site"). Encarnacion ("we," "us," "our") operates this Site. By browsing, creating an account, or placing an order, you agree to these Terms, our Return & Refund Policy, Shipping Policy, and Privacy Policy. If you do not agree, do not use the Site.

We sell as the merchant of record. Orders are fulfilled by third-party suppliers and warehouses ("Suppliers"). Shopify Inc. hosts the storefront and checkout. Shopify is not the seller of your order.

1. Eligibility You must be the age of majority in your place of residence, or have a parent or guardian's consent. You may not use the Site for any illegal purpose or in violation of any law, including copyright and consumer-protection laws.

2. Dropshipping and fulfillment Encarnacion is a dropshipping store. When you order, we transmit the order to a Supplier who ships the product to the address you provide. We do not hold most inventory in our own warehouse. Products may ship from facilities in the United States or from overseas. Shipping origin, carrier, and transit time can vary by item and by Supplier.

We are responsible to you as the seller. The Supplier is not a party to your purchase contract with us. You will not contact a Supplier to change, cancel, or dispute an order. All requests go through Encarnacion.

1. Products, descriptions, and pricing We try to describe products accurately, including size, color, material, and function. Photographs are examples. Color, finish, and measurements can vary because of lighting, screen settings, manufacturing batches, and Supplier differences. A reasonable variance is not a defect.

Prices are shown at checkout in the currency displayed and may change at any time before you place an order. We may limit quantities, refuse or cancel an order, or discontinue a product, including after you submit an order, if we detect error, fraud, stock loss, or a pricing mistake. If we cancel, we refund amounts actually charged for that order.

1. Orders and payment Placing an order is an offer to buy. We accept that offer when we send an order confirmation. We may refuse or cancel any order for any lawful reason, including suspected fraud, reseller activity, or inability to fulfill.

You agree to provide current, complete, and accurate billing, shipping, and contact information. Payment is processed by Shopify Payments, Shop Pay, or another method we enable at checkout. You authorize us and our payment providers to charge the payment method you use.

Title and risk of loss pass to you when the Supplier delivers the product to the carrier, except where law requires otherwise.

1. Shipping, customs, and delivery times Delivery estimates on the Site are not guarantees. Dropshipped and overseas shipments often take longer than domestic retail, commonly 7–21 business days after dispatch, and sometimes longer during peak periods or customs review. We are not liable for carrier delay, customs delay, weather, or events outside our control.

You are responsible for providing a complete and correct shipping address. We are not responsible for packages marked delivered, left with a neighbor, stolen after delivery, or sent to an address you entered incorrectly.

If a shipment is held by customs, you are responsible for duties, taxes, and brokerage unless we stated otherwise at checkout. Refusal to pay duties may result in return or destruction of the package without a refund, except where law requires otherwise.

1. Returns and refunds Returns and refunds are governed by our Return & Refund Policy, which is part of these Terms. In summary: you may request a return within 14 days of delivery for unused items in original packaging. Original shipping is not refunded unless we sent the wrong item. Return shipping is yours unless the error was ours.

Damaged or modified products will not be compensated. We do not issue refunds, replacements, store credit, or any other compensation for products you damage, alter, assemble, customize, wear beyond a reasonable inspection, wash, repair, or otherwise modify after delivery. Misuse, neglect, missing parts caused after receipt, or attempted repair also disqualify the order.

If an item arrives defective or damaged in transit, contact us within 48 hours of delivery with photos of the product, inner packaging, outer carton, and shipping label. We will replace or refund it at our discretion after review. Final-sale, clearance, and personalized items cannot be returned unless they arrived defective.

Chargebacks filed without first contacting us may result in account restriction. If you open a dispute, we may share order, tracking, and correspondence records with the payment provider.

1. Cancellations You may request cancellation before the Supplier marks the order as shipped. Once shipped, the order follows the Return & Refund Policy. We may cancel if a Supplier cannot fulfill, if the product is out of stock, or if we cannot verify your payment or address. Cancelled unshipped orders are refunded to the original payment method.

2. Prohibited use You may not: use the Site for any unlawful purpose; infringe intellectual property; harass or discriminate; submit false information; upload malware; scrape, spider, or harvest personal data; interfere with the Site's security; or resell products as a dealer without our written consent. We may terminate access for any violation.

3. Intellectual property The Encarnacion name, logos, Site design, text, and original graphics are owned by us or our licensors. Product photos and descriptions may be provided by Suppliers and remain subject to their rights. You may not copy, scrape, or reuse Site content for a competing store.

4. Reviews and submissions If you post a review, photo, or comment, you grant us a non-exclusive, royalty-free license to use it on the Site and in marketing. Do not post unlawful, fake, or infringing content. We may remove content at our discretion. Reviews must reflect your actual experience with Encarnacion.

5. Third-party services The Site may link to or use third-party tools, including Shopify, payment processors, carriers, review apps, and ad platforms. Those services have their own terms. We are not responsible for third-party sites or outages.

6. Disclaimer The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

7. Limitation of liability To the fullest extent permitted by law, Encarnacion and our officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or replacement costs, arising from your use of the Site or any product.

Our total liability for any claim related to an order will not exceed the amount you paid to Encarnacion for that order. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted by law.

1. Indemnity You agree to indemnify and hold harmless Encarnacion and our officers, employees, and contractors from claims arising out of your breach of these Terms, your misuse of a product, or your violation of law or third-party rights.

2. Privacy Personal information is handled under our Privacy Policy. Because we use Suppliers and Shopify, your shipping name, address, and order details are shared as needed to fulfill and support the order.

3. Changes We may update these Terms by posting a new version on this page. The "Last updated" date will change. Continued use of the Site after a change means you accept the new Terms.

4. Governing law These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules, except where the mandatory consumer laws of your place of residence apply and cannot be waived. Courts located in New York, New York will have jurisdiction, except where the law of your residence requires otherwise.

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, plus the policies linked above, are the entire agreement between you and Encarnacion for use of the Site and for purchases.
